Egyesek.hu Services
This is the General Terms and Conditions of egyesek.hu (hereinafter: Website) operated by Egyesek Youth Association (hereinafter: Service Provider or Organization or Egyesek). Entering the website and its content elements as well as using any of its services means the reading and acceptance of the General Terms and Conditions as well as its data management principles regarding the usage and services provided by egyesek.hu.

The service software is owned by Egyesek Youth Association. The service is operated by Egyesek Youth Association.
Credit card payment through the website is in every case carried out through the payment system of Barion Payment Zrt. which Service Provider does not have access to.
I. Terms
For the purposes of this General Terms and Conditions:
Donation or Donating: Financial support given by the Donor to the Organisation without consideration by accepting the present General Terms and Conditions. Donation can be carried out via credit card.
Donor: A person or organization donating money to the Organization without any consideration that accepts the terms and conditions of this General Terms and Conditions.
Donating by Bank Card: Online payments by bank cards are done by the Barion system. The data of the bank cards does not reach the Service Provider. Barion Payment Zrt. is under the supervision of the Hungarian National Bank, the permission number is H-EN-I-1064/2013. Payment by credit card carried out through the interface of Barion Payment Zrt. Service Provider is not responsible for the transaction and does not have access to transaction details.
Target Amount: Amount needed for the project implementation, set by the Organisation when uploading a Project. The Organisation may decide to continue receiving donations after reaching the Target Amount.
User: Visitor, Donor, Registered donor.
Website: Egyesek.hu website operated by Egyesek Youth Association.
Visitor: A person wholly or partly knowing the content of the Website.
Sharing: Distribution or promotion of the Project either through social media channels, by e-mail or any other channels.
Sharer: A Visitor promoting the Project either through social media channels, by e-mail or any other channels.
Project: The specific purpose for which the donation is made. There are three main types of projects: individual support, project support, operation support.
Recurring Credit Card Deduction: A monthly payment of a credit card donation, where the donation amount set by the Donor is deducted on the 11th of each month. The Donor will give you a password on the Barion Payment Zrt. page, with the comment that the service can be canceled later, the card data can be modified directly at Barion Payment Zrt. or can be canceled on the website for registering on the website and the amount to be donated can be changed.
Registered Donor: A donor who registered his or her e-mail with a password and has an own Administration Interface for tracking his or her donations as well as for donating easier and faster without giving his or her details each time.

Donation/Donating by telephone: A donation by the donor to the Organization for a call by phone or by SMS is a 500 HUF subsidy. It will be paid to the Organization only if the Donor has settled the relevant monthly invoice.
By phone call: Following the dial of number 13600 and the beep, the Donor is able to donate 500 HUF by dialing the extension number of 65.
By SMS: The Donor is able to donate 500 HUF by sending the technical number 65 to the number 13600.
The beneficiary of telephone donation program is the Organisation. The program is realised by the cooperation of the four largest telecommunications company (Invitel, Magyar Telekom, Telenor Hungary and Vodafone Hungary). The legal environment is created by the regulation of National Media and Infocommunications Authority.
Issue of the donation certificate: For of individual entrepreneurs and other legal entities, the Donor will send the following informations for info@egyesek.hu no later than 31 January of the year following the year of donation:
Datas required from private individuals: name, address, tax identification number, e-mail address
Datas required from legal entity: company name, tax number, trade register number, e-mail address
The Organisation issues the certificate to the Donor’s e-mail address by 5 February.
II. Basic Conditions, Scope of General Terms and Conditions
This General Terms and Conditions contains the parties’ rights and obligations regarding the service relationship between the Service Provider and persons and entities using the website.
Users must agree to be bound by these terms and conditions during the duration of their registration and the use of the services of the Website.
The Service Provider is not responsible for the activities of the User. The Donor cannot exercise rights through the Service to the Organisation.
The Service Provider reserves the right not to authorize the use of the services.
For technical problems outside the scope of the Service Provider (especially, but not limited to, deletion of the e-mail address, inaccessibility, connection error, server computer performance, network load, network congestion, coverage, and secure network connection) the Service Provider cannot be charged and excludes all claims for damages. The Service Provider excludes its liability for failure of the Website for reasons beyond its control, during which time it may not be or is limited accessible, but it shall take all necessary measures to detect or eliminate the cause of the defect as soon as possible
The Service Provider undertakes to seek mutual understanding in disputes and to cooperate in order to mutually agree on the dispute.
Services and Their Use, Fees
Projects (“Ongoing Campaigns”)
The process of uploading projects is regulated by this General Terms and Conditions.
Only the Service Provider is entitled to upload projects.
The Service Provider has the right to edit and delete projects. The Donor cannot claim for damages in this case.
Service fees
In the case of a credit card payment, fees regarding credit card payments will be deducted by Barion Payment Zrt. based on the current fees the company applies.
End of the project:
The project ends with reaching the target amount. The last registered donation, which exceeded target amount, will be wholly the part of the collected donation.
For any project, the project can be closed. In this case, the Organization is still entitled to use the amount of donations received before the closure date.
The Service Provider keeps the received Donations on its own bank account, the Credit Card Donations are transferred directly from Barion Payment Zrt. to the Organization. Donations by phone call and SMS are also transferred directly from the NIOK account to the Organization’s account after deducting the costs of the service.
10% of the amount of collected donations (credit card, telephone, SMS) can be used by the Service Provider for the technical maintenance, administration and payment of bank charges. The Service Provider uses 90% of the amount of the Donations for the purposes of the Project that are declared by the Organization in its Annual Public Benefit Statement.
The Donor acknowledges that if the individual or project goal is not achievable due to the failure of reaching the target amount, the total amount of the donation will be used for the purposes of the Organization.
The Service Provider reserves the right to promote the Projects on the website and through other communication channels and to place ads, presentations or donor messages on the website.
Projects may remain publicly available on the website after the expiry of the collection period.
If the implementation of the Project is not possible for reasons beyond the control of the Organization, the Organization is entitled to spend the received donations to a project which is similar in content to the original.
Report
The Organization undertakes to inform its donors about the use of the Donations in advance as well as subsequently by 30 June of the following year through the Annual Public Benefit Report.
III. DONORS

Donor registration is not obligatory. By registering the Donor is able to track its donations as well as cancel automatic monthly donation.
Donation process
Donation activity on the website is only possible by the acceptance of this General Terms and Conditions.
Any person or organization is entitled to donate by credit card. The donor may use the following credit cards on the website: MasterCard (embossed), VISA (embossed), American Express (embossed), VISA Electron (not embossed), Maestro, Google Pay, Apple Pay.
On the platform of the Donation, the User is able to choose from various options by clicking on one of the different categories.
„Individual or Self-funding Campaign” For our current programs, where 1 to 1 participant can be supported by the User. Here must be the name of the friend / friend to be supported and the amount of the donation given.
„Projects” This category contains the Projects created by the Organization, for which is currently being collected. Here the User must give the amount.
„Operation” Donations of different value can be offered for the Organization’s operating expenses.
In any case, after entering the data, you can go through the process by clicking the „Donate” button. After you have placed your Donation you can then read and accept the General Terms and Conditions.
After clicking on the „Donate” button, the Donor will proceed to Barion Payment Zrt. page where the Donor can enter their credit card details that are required for payment. Neither the Service Provider nor the Organization has access to the credit card data, they are managed by Barion Payment Zrt.
Following the donation, the donor receives a thank you message and confirmation information.
The message written and published by the donor may be used by the Service Provider to promote the website with or without the donor’s name being displayed.
Donation Counter on the Website
The donation counter will document the gross amount of donations received through the fundraiser tools of the Service Provider. For all tools, the total amount of the donation is taken into account, ie. the fees charged by the Service Provider, the retained donations, the termination fees deducted by the telephone service providers and the credit card payment fees deducted by the payment systems will not be deducted from this amount.
IV. Data Management
The Service Provider shall record and use the personal information given by the User in accordance with the data protection regulations of the this General Terms and Conditions which is also available on the Website.
Data management statement:
By clicking the Pay button the Customer accepts Egyesek Youth Association (52/A Visegrádi utca, 1132 Budapest, Hungary) at egyesek.hu to provide the following personal data stored in its user database to Barion Payment Zrt. 4-20. 2. floor Irinyi József utca, 1117 Budapest, Hungary. Provided data: family name, given name, e-mail address, amount and in case of Self-funding campaign motivation and profile photo as well.
The purpose of data transmission: customer support for users, confirming transactions and fraud-monitoring for users defense.
V. Other User Rights and Obligations
Complaint Handling
Visitors and Donors may submit their complaints and comments by e-mail to info@egyesek.hu. Complaints will be investigated by the Egyesek Youth Association within 30 days and will notify the whist blower about the outcome of the investigation by e-mail.
Cancellation of the right to reclaim the Donation (Gift)
The Contracting Parties declare that the donor expressly renounces the right to reclaim the Donation without conditions and restrictions.
The Donor may only terminate or refrain from denying performance in the case of a serious breach of contract by the other Party under this General Terms and Conditions. Serious breach of contract is the use of donation contrary to the original purpose.

The Service Provider maintains contact with Visitors and Donations via the Website.
VII. Final clauses
The Service Provider is entitled to modify this General Terms and Conditions by publishing the new version on the Website.
